Legacies are gifts of property (other than land or buildings).
They can be Specific, for example my Rembrandt painting.
Or general, a 24-piece dinner set. Or Pecuniary, $100 from my Westpac account.
Specific gifts will fail if you do not still own them at the date of your death. If you do not want them to fail you should provide for a substitute, for example, "or such other paintings as I own on the date of my death". General gifts will not fail if you do not own them at the date of your death. Your executor(s) will have to purchase them using money from your estate.
